E-Way Bill Validity Rules

Under Rule 138(10) of the CGST Rules, every e-way bill has a limited validity period based on the distance the goods need to travel. Once the validity expires, the goods cannot be moved further without extending or generating a new e-way bill.

When is E-Way Bill Required?

  • Consignment value exceeds ₹50,000 (including tax)
  • Inter-state movement of goods (regardless of value in some cases)
  • Movement by a registered person (even for reasons other than supply)
  • Movement by an unregistered person if recipient is known

Exemptions — No E-Way Bill Needed

  • Goods transported by non-motorized conveyance
  • Goods transported from port/airport to ICD/CFS for customs clearance
  • Transit cargo moving to/from Nepal or Bhutan
  • Movement of empty cargo containers
  • Goods exempt from GST (Schedule III items)
  • Specific goods: LPG for household, kerosene (PDS), postal baggage, currency

Extension of Validity

If goods cannot reach the destination within the validity period (due to breakdown, transshipment, natural calamity, or law and order issues), you can extend the e-way bill:

  • Extension must be done before expiry or within 8 hours after expiry
  • Update Part B with new vehicle number if the vehicle has changed
  • Each extension adds validity based on remaining distance
